Privacy policy
At My Com Swiss Sàrl, protecting your personal data is a priority. This policy explains what data we receive, why, who it is shared with and what your rights are.
Who is responsible for your data?
My Com Swiss Sàrl, a web agency based in Geneva (Rue des Alpes 5, 1201 Geneva), is the controller of the data collected via the mycomswiss.ch website.
Dedicated contact: contact@mycomswiss.ch
What data do we receive?
Only the data we need:
- Contact and quote form: name, company, e-mail address, phone number, the services you are interested in, your intended budget and your message. Only your name, e-mail address and message are required.
- Visibility audit: the address of the website to be analysed, your line of business and your city; if you request the full report, your e-mail address.
- Website assistant: the questions you ask it and the page you are on; if you request a callback, your first name and a phone number or e-mail address.
- Appointment booking: if you book a slot, your name, your e-mail address and the time you choose are recorded by Google Calendar, our booking tool, which sends you the confirmation and the video call link.
- Technical data: as with any website, our hosting provider records the IP address, the page requested, the date and the browser type in its logs, to keep the website running and secure.
- Audience measurement: only if you accept it in the cookie banner, Google Analytics 4 and Microsoft Clarity record the pages you view, the length of your visit, your clicks and scrolling, your device and browser type, your approximate region and the website you came from. Without your consent, neither tool loads.
We do not collect any sensitive data (health, political opinions, etc.).
The contact form
Your request is sent to us by e-mail, to our business mailbox (Google Workspace). It is not stored on the website itself. We only send it if you tick the consent box on the form.
You also receive a confirmation e-mail at the address you provided. It does not repeat your message and is used for nothing else.
To block automated submissions (spam), we keep a hash of your IP address and the time of your submissions for one hour: the address itself is not stored, and this information is used solely to limit the number of requests.
Appointment booking
The “Pick a slot” button (on the Contact page and in the website assistant) opens Google’s booking calendar (Google Workspace appointment scheduling). It only loads when you click it. The information you enter there (name, e-mail address, time slot, any comment) is processed by Google to create the appointment in our calendar and to send you the confirmation, the Google Meet link and a reminder. It is governed by Google’s privacy policy.
The visibility audit
- The website address you enter is read by our server (home page only) and passed to Google PageSpeed Insights, which measures its speed. As with any connection to an online service, Google then receives your device’s IP address.
- The website address, your line of business and your city are passed by our server to DataForSEO, which measures your position on Google and Google Maps, collects the answers from ChatGPT and Gemini and, for the full report, Google Ads data. No personal data is passed to it.
- To prevent abuse, we keep a hash of your IP address and the time of your analyses for one hour, as we do for the form.
- If you request the full report, your e-mail address is used to send it to you (a PDF generated on our server) and, if you agree by ticking the box, to contact you again about this audit. We receive a copy in our business mailbox (Google Workspace): it is not stored on the website itself, and your address is never passed to DataForSEO.
- The results of a search (line of business and city, not linked to you) are kept on our server for 24 hours, and your analysis for no more than 2 hours, long enough for you to request the report. To prevent abuse, we also keep a hash of the e-mail address provided for one hour.
- Even if you do not request the report, we receive a summary of the audits run the following morning: the website address, the line of business, the city and the positions found, without your e-mail address or your IP address. This information is kept on our server for 8 days, long enough to prepare the summary.
The website assistant
Your questions are sent by our server to Google (Gemini API, paid business plan) to generate the answer, together with the page you are on and the website’s public information (services, prices, method). Google does not use these exchanges to train its models. The conversation stays in your browser for the duration of your visit; we only keep the question asked and the page, without e-mail or IP address, for 8 days, to improve our answers (daily summary).
If you request a callback, your first name and your phone number or e-mail address are sent to us by e-mail, like a request made via the contact form. To prevent abuse, a hash of your IP address and the time of your messages are kept for one hour.
Audience measurement
Two tools help us understand how the website is used, so that we can improve it. They only load after you consent in the cookie banner, and we do not use them for advertising purposes.
- Google Analytics 4 (Google) counts visits and pages viewed. Its cookies tell one browser from another, without revealing your identity to us. It does not record your IP address.
- Microsoft Clarity (Microsoft) shows how pages are browsed: clicks, scrolling and pointer movements, in the form of heatmaps and session replays. Anything you type into a field is masked: we cannot see it.
You can withdraw your consent at any time using the “Manage cookies” link at the bottom of every page: both tools stop and their cookies are deleted.
Why do we use your data?
- To reply when you contact us or request a quote;
- To carry out the visibility audit you request, send you its report and, if you agree, contact you again about it;
- To monitor use of the visibility audit (daily summary of audits run);
- To answer your questions via the website assistant and keep track of the questions asked (daily summary);
- To measure traffic on the website and improve its pages, if you agree;
- To manage the client relationship and deliver our services;
- To protect the website against spam and abuse;
- To comply with our legal and accounting obligations.
On what legal basis?
- Your consent, for sending the form and the audit report, non-essential cookies and marketing communications;
- The performance of a contract or of pre-contractual measures, for your quote requests and our services;
- Our legitimate interest, for the security of the website, the fight against spam, the monitoring of the visibility audit and the operation of the website assistant;
- Our legal obligations, for the retention of certain accounting data.
We apply the Swiss Federal Act on Data Protection (FADP), in force since September 2023, and, for visitors from the European Union, the General Data Protection Regulation (GDPR).
Who do we share your data with?
Your data is never sold. Only the following service providers have access to it, for the purposes described above:
- Google (Google Workspace and Google PageSpeed Insights): our e-mail and the audit’s speed measurement;
- Google (Google Calendar): online appointment booking, if you choose a slot;
- Google (Gemini API): the website assistant’s answers;
- Google (Google Analytics 4): audience measurement, if you accept it;
- Microsoft (Microsoft Clarity): analysis of how the pages are used, if you accept it;
- DataForSEO (DataForSEO OÜ, Estonia): the positions on Google and Google Maps and the AI answers for the audit, based solely on the website address, the line of business and the city;
- OVH (France): website hosting;
- Sanity: the images in our content (articles, case studies) are served from its servers, which your browser contacts to display them;
- public authorities, where required by law.
Google, Microsoft and Sanity may process data outside Switzerland, particularly in the United States. These transfers are based on safeguards recognised by Switzerland, such as the Swiss-U.S. Data Privacy Framework or standard contractual clauses.
How long do we keep your data?
- IP address hash (anti-spam): one hour.
- E-mail address hash (audit abuse prevention): one hour.
- Audit searches, with no personal data: 24 hours.
- Log of audits run (website, line of business, city and positions, without e-mail or IP address): 8 days.
- Questions put to the assistant (question and page, without e-mail or IP address): 8 days.
- Contact requests and audit reports not followed up: 12 months maximum.
- Data of active clients: for the duration of the contractual relationship, then as required by law (10 years for accounting data).
- Browsing data (technical logs, cookies): 13 months maximum.
- Audience measurement: cookies kept for no more than 13 months; visit data kept for no more than 14 months by Google Analytics, and for 30 days (session replays) and 13 months (statistics) by Microsoft Clarity.
After these periods, your data is deleted or anonymised.
Your rights
You can exercise the following rights at any time by writing to us at contact@mycomswiss.ch:
- Access your data;
- Have it corrected or deleted;
- Object to its processing or ask for it to be restricted;
- Withdraw your consent, without affecting any processing carried out beforehand;
- Lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC).
We undertake to respond to any request within 30 days.
