Terms and conditions

Updated: October 2026

These General Terms and Conditions (GTC) set out the framework of the business relationship between My Com Swiss Sàrl and its business clients. They apply to every order for services, unless otherwise agreed in writing.

My Com Swiss Sàrl

Legal form: limited liability company (Sàrl) under Swiss law

Registered office: Rue des Alpes 5, 1201 Geneva, Switzerland

UID number: CHE-277.608.321

Contact: contact@mycomswiss.ch

“Client” means any legal entity or natural person acting in a professional capacity.

Services covered

These GTC apply to all our services:

  • Website design and redesign (business websites, e-commerce, landing pages), using the technology best suited to each project: WordPress, Shopify, Webflow or custom development;
  • Search engine optimisation (SEO) and optimisation for AI assistants (GEO);
  • Advertising campaign management (Google Ads, Facebook and Instagram);
  • Website maintenance;
  • Digital marketing consulting, training and support.

The details of the services, deliverables and prices are set out in the quote or commercial proposal accepted by the Client.

Contractual commitment

The business relationship is formalised by signing or confirming a quote in writing. From that acceptance onwards, these GTC form an integral part of the contract.

Any request for changes during the assignment is subject to an amendment or a new quote.

Obligations of My Com Swiss Sàrl

We undertake to perform the agreed services with diligence and professionalism, in line with the indicative timelines set together. Our commitment is an obligation of means (best efforts), not of result: we cannot guarantee specific results in terms of rankings or traffic, as these depend on external factors (algorithms, competition, user behaviour).

Obligations of the Client

So that we can work efficiently, the Client undertakes to:

  • Provide us with the necessary information, content and access within the agreed timeframes;
  • Approve interim deliverables within a reasonable time (failure to respond within 10 working days constitutes tacit approval);
  • Ensure that the content provided does not infringe the rights of third parties.

Any delay attributable to the Client may result in delivery dates being postponed.

Prices and invoicing

Prices stated in quotes are expressed in Swiss francs (CHF), excluding VAT where applicable. My Com Swiss Sàrl reserves the right to revise its prices, without affecting quotes that have already been accepted.

Depending on the nature of the service:

  • Fixed-price projects: a 50% deposit is due before work begins, and the remaining 50% at the end of the project, on delivery.
  • Recurring services (SEO and AI search, Google Ads, Facebook and Instagram advertising, monthly maintenance): invoiced monthly, at the beginning of the month. Yearly maintenance: invoiced once, at the beginning of the period.

Any invoice not paid by its due date will result in the suspension of ongoing services.

Late payment

If payment is not made by the due date, default interest at the Swiss statutory rate applies automatically, without prior formal notice. My Com Swiss Sàrl reserves the right to suspend ongoing services until payment is made.

Ownership of deliverables

Work created specifically for the Client (mock-ups, content, code) is transferred to the Client upon receipt of full payment. The generic tools, methods and resources used in production remain the property of My Com Swiss Sàrl.

The Client agrees that My Com Swiss Sàrl may list the project among its references, unless otherwise agreed.

Mutual confidentiality

Both parties undertake not to disclose any confidential information exchanged in the course of the business relationship. This undertaking applies for the entire term of the contract and remains in force for 2 years after it ends.

Limitation of liability

The liability of My Com Swiss Sàrl may not exceed the total amount paid by the Client in the 12 months preceding the dispute. Under no circumstances may it be held liable for indirect damage such as loss of revenue, damage to reputation or loss of data.

Termination

SEO (search and AI) and advertising services (Google Ads, Facebook and Instagram) are agreed for a minimum term of 6 months from their start date: these channels work over time, and that is how long it takes to achieve solid results and measure them. After this period, they continue on a monthly basis and either party may end them in writing (an e-mail is enough) with 30 days’ notice, effective at the end of a month. If the Client terminates before the end of the minimum term, the remaining monthly fees up to that term remain due. Maintenance is available monthly, cancellable with the same notice, or yearly: the yearly plan, at a reduced price, runs for 12 months and renews for another year unless terminated in writing at least 30 days before its end. Fixed-price projects in progress at the time of termination are invoiced in proportion to the work completed.

Dispute resolution

In the event of a disagreement, the parties undertake to seek an amicable solution before bringing any legal proceedings. Failing this, the courts of the Canton of Geneva have exclusive jurisdiction, and Swiss law applies.

Severability

If any provision of these GTC is declared invalid, the remaining provisions shall remain in full force and effect. Failure to invoke a provision does not constitute a waiver of it.
